Lolita's captors, also known as the Dolphin Company, have ignored veterinary recommendations and continued to put her at risk. They harm her health by forcing Lolita to perform for tourists. They push her to the limit with high-speed circles and head-first diving, which exposes her to chlorine and cause her to lose weight. Additionally, they put her in a tiny tank that is less than one-and-a half times the size of her natural habitat.

Fortunately, in 2022, the new owner of Miami Seaquarium pledged to work with an organization of Lolita advocates known as Friends of Toki and the Lummi tribe who consider her a relative in a plan to eventually transport her to the open water. The plan included a facility in Washington's westcoast, where she could live the remainder of her life and receive human care and be monitored by scientists. The sanctuary pen could be hundreds of times bigger than her Miami home, and would be surrounded by the ocean not an empty concrete tank.

If the plan was successful, Lolita (also called Tokitae or Toki) could be alive. In the wild, killers whales are social animals who connect with their families until they die. Lolita, who has lived alone at Seaquarium in isolation for 40 years, is being released into the wild. After years of pressure from PETA and others, the Miami Seaquarium has finally released Lolita to a sanctuary on the ocean and she will be able to take a deep dive in the ocean and possibly even be reconnect with her orca mother. Sadly the plans came too late for the whale that was so beloved, who died on Friday from what was believed to be a kidney issue.
